| Summary: | On 11th February 2013, a Rescript ex audientia Pontificis given by the Secretary of State includes the concession of a series of special faculties to the Dean of the Roman Rota for a period of three years, deeply modifying the procedural rules of this Court. This Rescript includes new features as relevant as the suppression of the duplex conformis for Rotal sentences declaring the nullity of marriage, prohibition to introduce the new presentation of the case after marriage of one of the spouses, prohibition to appeal against Rotal decisions in matters of nullity of sentence or decrees, and grants the Dean of the Roman Rota the faculty to dispense from procedural laws. In this article, the author analyzes the contents of this Rescript and makes some considerations about its foundation and application, as well as the peculiarities of its publication. She also suggests some legislative changes which may help to improve the process for declaring the nullity of marriage, making it more agile, without prejudice to the necessary legal certainty. El 11 de febrero de 2013, un rescripto ex audientia Pontificis de la Secretaría de Estado recoge la concesión, al Decano de la Rota Romana, por un período de un trienio, de una serie de facultades especiales que modifican profundamente la normativa procesal de este Tribunal. Este rescripto incluye novedades tan relevantes como la supresión de la duplex conformis para las sentencias rotales declarativas de la nulidad, la prohibición de interponer la nueva proposición de la causa tras el matrimonio de uno de los cónyuges, la prohibición de apelar contra las decisiones rotales en materia de nulidad de sentencia o decretos, y la concesión al Decano de la Rota Romana de la facultad de dispensar de las leyes procesales. En este artículo, la autora analiza el contenido de este rescripto y hace algunas consideraciones acerca de su fundamento y aplicación, así como sobre las peculiaridades de su publicación. Asimismo, se sugieren algunos cambios legislativos que contribuirían a mejorar el proceso de nulidad matrimonial, haciéndolo más ágil, sin perjuicio de la necesaria seguridad jurídica. |
