| Summary: | The Instruction Dignitas Connubii —published several months ago by the Pontifical Council for Legislative Texts— contains the norms to be observed at ecclesiastical tribunals in matrimonial proceedings. This Instruction develops the norms of the Code of Canon Law, and presents in a unified manner the whole canonical process of matrimonial nullity, and integrates the juridical developments that occurred in the last 20 years, since the promulgation of the Code. The Instruction attempts to improve the administration of justice throughout the Church and to help tribunals handle their work better. However, the interpretation and application of this Instruction at ecclesiastical courts can also cause some difficulties that need to be clarified. This article analyses the text of the Instruction and underlines what is new with regard to the canons of the Code, attempting to offer interpretative criteria that facilitate the application of the new norms. La Instrucción Dignitas Connubii —publicada hace varios meses por el Pontificio Consejo para los Textos Legislativos— contiene las normas que deben observarse en los tribunales eclesiásticos en las causas matrimoniales. Esta Instrucción desarrolla las normas del Código de Derecho Canónico, presenta linealmente las disposiciones relativas al proceso canónico de nulidad matrimonial, e integra los desarrollos jurídicos que han tenido lugar en los últimos 20 años, desde la promulgación del Código. La Instrucción pretende mejorar la administración de la justicia eclesial y ayudar a los tribunales a realizar mejor su trabajo. Sin embargo, la interpretación y aplicación de esta Instrucción en los tribunales eclesiásticos puede originar algunas dificultades que es conveniente aclarar. Este artículo analiza el texto de la Instrucción y subraya sus novedades respecto a la regulación codicial, intentando ofrecer criterios de interpretación que faciliten la aplicación de la nueva normativa. |
