| Summary: | Because of my job as part of the Court of Rota from the Spanish Apostolic Nunciature I have recently noticed a reality that arouses my interest because of its prevalence and because of its legal, canonical and pastoral consequences. Often marital coexistence lasts only a few months even though it has been surprisingly preceded by an extraordinary long engagement, of, at least, eight years. In order to evaluate this situation I have considered several real cases processed in our ecclesiastical court. After deeply analyzing them, several data and different considerations are done, special mention given to the probatory law in relation the subject. This article ends up with some personal considerations and thoughts related to these situations. Al desempeñar mi labor profesional dentro del Tribunal de la Rota de la Nunciatura Apostólica en España, he advertido una realidad fáctica que ha suscitado mi interés. Interés motivado por su incidencia en la práctica y por las repercusiones que, a nivel jurídico-canónico y pastoral, se derivan. Se trata de supuestos en los que la convivencia matrimonial dura tan sólo unos meses, siendo precedida, paradójicamente, por una relación de noviazgo extraordinariamente larga, de un mínimo de ocho años de duración. Se toma como base de este estudio una serie de casos reales tramitados ante nuestro Tribunal, en los que acontece tal supuesto práctico; analizados los mismos, se aportan datos y se realizan diversas consideraciones relativas al derecho sustantivo aplicable, con especial mención al derecho probatorio en relación con la materia; finaliza el artículo con unas concretas reflexiones personales. |
