Description
Summary:The competence of Signatura for the "nova causae propositio" (NCP) seems to have originated as an extension of the "restitutio in integrum" to Rotal sentences in matrimonial cases. It became the examination of a recourse against the denial of the NCP by the Rota, also reguarding double conforming decisions of lower tribunals. The possibility of three decisions on the same question constitutes an anomaly. The question was not resolved in the 1983 CIC, nor in "Pastor bonus", nor in "Lex propria". Recently the Rotale Collage excluded recourse to the next turnus against the denial of the NCP
