With regard to the totalitarian state, Pius XI formulates the basic fact that man as a person possesses rights that were passed on to him from God. Magnus Striet deconstructs the appeal to any "ius divinum". Lutz Richter-Bemburg is inspired by the idea that any reference to "ius divinum" is merely subsidiary. The thesis of this article is on how God's revelation of Himself - "ius divinum" can be identified as God's fidelity to humankind in incorporating an acknowledgement of the dignity of each individual and thus expressed in the form of human rights. Die Diskussionslage um das Verhältnis von Gottesrecht und Menschenrechten wird durch verschiedene, kaum miteinander vereinbare Ansätze bestimmt. Gegenüber dem totalitären Staat formuliert Papst Pius XI. die grundlegende Tatsache, dass der Mensch als Persönlichkeit gottgegebene Rechte besitzt. Magnus Striet bestreitet die Gründung der Menschenrechte im "ius divinum". Lutz Richter-Bernburgs Position ist von der Idee inspiriert, dass auf das "ius divinum" nur subsidiär Bezug genommen werden dürfe. In der Diskussion dieser Positionen wird die These vertreten, dass das "ius divinum" aufgrund der göttlichen Selbstoffenbarung als die Personwürde des Menschen achtende und so Menschenrechte postulierende Treue Gottes zu den Menschen identifiziert werden kann. |
