However, the new Codes of 1983 and 1990 were based on the first period of interpretation of Vatican II and the CIC 1917. Pope Francis is demanding "the renewal of structures" of the Church (Evangelii Gaudium 27). There is a paradigm shift towards the new human rights perspective, which entered the Council with the encyclical Pacem in terris (1963). Paul VI deepened it with the "Lex Ecclesiae Fundamentalis" project, which is not yet promulgated. In Dignitatis Humanae bestätigt das Konzil das Konzept der Menschenwürde und somit das Subjekt der modernen Verfassungsgeschichte. Aber die neuen Kodizes von 1983 und 1990 basieren auf der ersten Periode der Konzilsinterpretation und auf dem CIC/1917. Papst Franziskus fordert nun eine „Reform der Strukturen" der Kirche (Evangelii Gaudium 27). Jetzt ist es Zeit für die neue Menschenrechtsperspektive, die mit der Enzyklika Pacem in terris (1963) ins Konzil eintrat. Paul VI. vertiefte diese mit dem Projekt des "Grundgesetzes" ("Lex Ecclesiae Fundamentalis"), das noch nicht promulgiert wurde. |
