Summary:The goal of this article is to investigate the intersection between gender, sexual orientation, and religion. This will be done by exploring three different trajectories (theological, phenomenological, and legal). Drawing the attention to the historical clash between religion and homosexuality, this paper highlights evolutionary developments on sexuality and religion from the second half of the twentieth century to the present day. In particular, by combining legal analysis and sociological thought, this study takes an interdisciplinary approach that considers the transformation of religion over time and across space, as well as its role in the construction of gender identity. By way of example, this paper shows how human rights in the twentieth century offered an alternative normative framework to the «monopoly powers» of Abrahamic religions over sexual choices and morality. In this vein, human rights come with the innovative potential not only to free homosexuality from the prejudices of religious orthodoxy, but also to make religious freedom itself a more elastic concept. In conclusion, by bringing the liberal approach of human rights into focus, it will be maintained that the higher the degree of religious diversity, the greater the «competition» between religion and LGBT people on the grounds of non-discrimination.
