Description
Summary:Can. 1395 and the Related Special Faculty of Dismissal from the Cerical State In Poenam. In the wide context of the special faculties granted to the Congregation for the Evangelization of People, the article aims to analyze the faculty to submit cases of dismissal from the clerical state in poenam to the Holy Father. In order to ensure an accurate survey of the matter, the articel divided in two parts: in the first, offences provided for by can. 1395 §§ 1-2 are examined, while in the second one, the above mentioned special faculty is analyzed. While in the first part only questions of substantial law are considered, the second one focuses on the profils of substantial law of the faculty grabted to the Congregation for the Evangelization of People and on ist procedural peculiarities
