| Summary: | This contribution argues that a strict interpretation of the prohibition on business activities by clerics in canons 286 & 1392 CIC/1983 can be self-defeating in those quarters of the Church where income is negligible. A rigorous application of the prohibition and sanction on business and trading activities by clerics contained in these canons combined with the practical unwillingness of ordinaries to grant exemptions bars clergymen from finding creative solutions to supplement the little income that they may procure. This leads to the paradox that clerics ministering in poor dioceses are often not remunerated sufficiently while a strict interpretation of canon law leaves them with no alternative that may provide for their living. Clerics in poor diocese are therefore frequently caught in a paradoxical situation. Dieser Beitrag argumentiert, dass eine enge Auslegung des c. 286 i. V. m. c. 1392 CIC/1983 zum Verbot der Kleriker, Handel zu treiben, in den Bereichen der Kirche nicht sinnvoll sein kann, in denen das Einkommen sehr gering ist. Die enge Anwendung des Verbots und der Strafe auf Handel und Gewerbetreiben für Kleriker, die in diesen Canones enthalten sind, werden mit dem praktischen Unwillen der zuständigen Ordinarien verknüpft, den Klerikern Ausnahmen zu gewähren, um kreative Lösungen zur Unterstützung ihres kleinen Einkommens zu finden. Das führt zu dem Paradoxon, dass Kleriker, die in armen Diözesen ein Kirchenamt ausüben, oft nicht ausreichend vergütet werden, während eine enge Auslegung des kirchlichen Rechts ihnen keine Alternative zum Bestreiten ihres Lebensunterhaltes lässt. Kleriker in armen Diözesen sind deshalb fortwährend in einer paradoxen Situation gefangen. |
