| Summary: | Walter Benjamin’s brief essay The Critique of Violence (1921) is one of the most thought-provoking and controversial texts in the entire history of political philosophy. Benjamin’s critique represents both a challenge for those who believe in the law, and an essential point of reference for its detractors. By reconstructing the complex structure of the essay’s argumentation, this study aims to identify a number of elements that can be used to explore the relationship between law and morality. Using force to impose moral principles, as judicial institutions do, also necessarily means compromising the conditions needed for the entire moral experience. In highlighting this risk, Benjamin’s essay continues to prove a valid aid for diagnosing the pathologies that arise when the law is taken to be the only possible medium for social interactions. |
