Summary:This analysis presents the origins of the dictrinal mindset of simulation and ist first legal construction (CIC 1917) which the decisive influence of Gasparri in the drafting of canon 1086 and ist interpretation. The requirement of a "positive act of the will" appers in the midst of a Christian cultural context in which it could be presumed that the contracting parties have a general intention of contracting marriage as it was instituted by God. This study gives the doctrinal basis to make an adequate interpretation of this requirement in the present juridical system within a social context quite different from tthat in which it was originally formulated
