| Summary: | Islamic rules of succession frequently come into conflict with core principles of European legal systems, including gender equality, freedom of testation and the protection of vulnerable individuals. This paper explores the main legal issues arising from the application of these norms within the Italian legal framework as well as the legal instruments that may help reconcile the religious identity of the deceased with the non-derogable guarantees of the domestic legal system. The aim is to propose a pluralistic model of succession governance that balances respect for cultural and religious diversity with the effective protection of fundamental rights. |
