Lack of faith and simulation · Canonical marriages are often celebrated by people who, although baptized, declare they no longer have faith. This aspect not only affects the exclusion of sacramental dignity but can also have legal implications for other cases of simulation, especially considering the art. 14 of the Roman Catholic Church’s motu proprio Mitis Iudex. Through an analysis of the doctrine and jurisprudence of the Roman Rota, we will demonstrate that this condition is considered a secondary legal fact, due to its ability to provide the breeding ground for simulation. However, it will never be possible to deterministically establish a presumption that directly links it to the existence of simulation ; on the contrary, its greater or lesser impact on the formation of the excluding will must be analyzed on case-by-case basis. |
