Summary:Thoughts on the labor law position of pastors and priests as employees of the church. The issue of labour-law relationships between pastors or priests and their employers (churches) is controversial because they (pastors or priests) are often regarded as employees and often not. These issues are discussed on the basis of problems in the South-African positive law and English law. In discussing the question about the nature of this labour-law relationship, a two-stage approach is suggested, especially when bearing in mind that the employment contract forms the basis of the labour-law relationship between the two parties.
