| Summary: | Die vorliegende Studie betrifft das Amt des Kirchenanwalts am Höchstgericht der Apostolischen Signatur bezüglich der Erteilung des Vollstreckbarkeitsdekrets für kirchliche Ehenichtigkeitsurteile im Licht des Konkordats. In diesem Zusammenhang werden die Merkmale des vielfältigen Amtes des Kirchenanwalts innerhalb der kirchlichen Rechtsordnung sowie das Ausmaß der Einbeziehung des vom Kirchenanwalt selbst ausgeübten gerichtlichen und beratenden Tätigkeit sowohl bei der Aufsicht über die Rechtspflege in der Kirche als auch im Hinblick auf das Verfahren zur Entstehung und zum Erlass des oben genannten Vollstreckbarkeitsdekrets der Signatur in Bezug auf Konkordatsehen und nicht konkordatäre Ehen untersucht. La trattazione in oggetto riguarda l’ufficio del Promotore di giustizia del Supremo Tribunale della Segnatura Apostolica nell’ottica concordataria della concessione del decreto di esecutività delle sentenze ecclesiastiche di nullità matrimoniale. In proposito vengono esaminate le caratteristiche del multiforme ufficio del Promotore in seno all’ordinamento canonico nonché il grado d’incidenza dell’attività giudiziaria e consultiva svolte dallo stesso Promotore sia nella vigilanza sull’amministrazione della giustizia nella Chiesa sia alla luce del procedimento di formazione ed emanazione del riferito decreto di esecutività della Segnatura in riferimento a matrimoni concordatari e non concordatari. The discussion in question concerns the office of the Promoter of Justice of the Supreme Tribunal of the Apostolic Signatura in view of the concordat of granting the decree authorizing the execution of ecclesiastical sentences of matrimonial nullity. In this regard, the characteristics of the multifaceted office of the Promoter within the canonical system are examined as well as the degree of incidence of the judicial and consultative activity carried out by the Promoter himself both in the vigilance over the administration of justice in the Church and in light of the process of forming and issuing the aforementioned decree of the Signatura in reference to concordat and non-concordat marriages. |
