| Summary: | The « equal freedom » of religious denominations in the Constitution of Italy. A principle to be discarded or reinterpreted ? · The article deals with the Constitutional principle of article 8, section 1, according to which « all religious denominations are equally free before the law ». The discussion around the content and scope of the principle is contextualised in the twofold contemporary global crisis of equality on the one hand and freedom on the other. It is suggested that against this background, it is possible to argue pessimistically that the principle cannot represent a meaningful tool for the protection of freedom of religion or belief. However, it is also possible to hold optimistically that the principle’s potential for the protection and advancement of religious equality and freedom still needs to be fully developed. 1.
