| Summary: | Could resource limitation legaly justify human mortality? Schematically, there are two positions on the matter: bioconservatism and neo-Malthusianism on the one hand, transhumanism and cornucopianism on the other, respectively symbolized by ambrosia, exclusively divine food, and the cornucopia, faith in abundance offered to men, in particular thanks to the progress of science. Between the two options, French law and the laws of bioethics allow some guidelines of thought. La limitation des ressources naturelles justifie-t-elle d'inscrire la mortalité humaine au rang des règles de droit ? Schématiquement, deux positions s'opposent en la matière : conservatisme et néomalthusianisme d'une part, transhumanisme et cornucopianisme de l'autre. Ces deux positions peuvent être symbolisées respectivement par l'ambroisie d'une part, nourriture exclusivement divine, et la corne d'abondance de l'autre, foi dans l'infini offert aux hommes, notamment par les progrès de la science. Entre les deux, le droit français et les lois de bioéthique offrent quelques pistes de réflexion. |
