Reference:The impediment disparitatis cultus establishes the invalidity of the marriage contracted between a Catholic and an unbaptized person. To avoid falling into assessment's errors of the importance of this norm, first an historical analysis of the formation of the impediment will be carried out, then the reason will be analyzed that led canonical Legislator to maintain, also in the 1983 Code, limitation on the right to marry. Having demonstrated that it is a limitation aimed at a more responsible exercise of this right, since it is a norm of ecclesiastical law, the causes that the authority must investigate to grant the dispensation will be addressed, showing how they are the hermeneutic key to understanding the reason for which we ask, also through the impediment in question, a careful evaluation by those who want to contract these marriages, especially in relation to their salus animae.
