Summary:On the status of children born from surrogacy practices abroad. Nihil novi ? Remarks on Supreme Court 30th December 2022, no. 38162 · After recalling the main stages of the judicial debate on the status of the child born through surrogacy, the paper analyses and discusses the latest decision of United Sections no. 38162/2022. The essay points out that the Supreme Court’s proposed solution, which essentially confirms that of the United Sections no.12193/ 2019, raises a few questions that emerge in some key passages of the reasoning framework. In the opinion of the a., adoption in special cases (art. 44, para. 1, lett. d), l. n. 184/1983), even after the recent Constitutional Court decision no. 79/2022, is unable to ensure adequate protection of the child’s interest in full legal recognition of the relationship with the intentional-non-biological parent.
