La relation que les Frères Prêcheurs ont nouée avec ce rassemblement inédit de juristes est longtemps restée dans l’ombre. Pourtant le combat qu’ils ont mené côte à côte a eu des retentissements certains sur la manière dont les Dominicains ont abordé le droit et les principes républicains. Le rosaire dans une main, le code dans l’autre, ils se sont saisis des ressources offertes par le droit pour lutter sur un terrain qui, de prime abord, leur était pourtant peu familier, faisant en cela montre d’une certaine modernité. En s’emparant ainsi de l’arme juridique, en s’investissant activement pour la défense de son couvent, de sa province et, au-delà, de son Ordre, la figure dominicaine se donne à voir sous un jour nouveau et différent de celui auquel l’historiographie a pu nous habituer. Between 1880 and 1903, during this period when anti-Congregationalism was still latent, the Mackau Committee was, for the Dominicans, a « light », a « guide », a « help », a « security ». The relationship that the Friars Preachers established with this unprecedented gathering of jurists has long remained in the shadows. Yet the struggle they waged side by side had a definite impact on the way the Dominicans approached the law and republican principles. With the Rosary in one hand and the Code in the other, they seized the resources offered by the law to fight in a field which, at first sight, was unfamiliar to them, thus showing a certain modernity. By seizing the legal weapon, by actively investing in the defense of its priory, its province and, beyond that, its Order, the Dominican is seen in a new light, different from the one to which historiography has accustomed us. |
