L’articolo percorre i vari stadi del processo, descrivendo le procedure relative alla eccezione di incompetenza relativa sollevata da una parte o dal difensore del vincolo. Si chiarifica la ragione della eccezione, che risiede nel principio del giudice naturale, imparziale perché predeterminato dalla legge. Si spiega l’importanza e i limiti dell’art. 10 §3 della istruzione Dignitas connubii. The exception of relative incompetence remains relevant even after the reform of matrimonial procedural law, which extended the fora of competency for those who bring forward a case of nullity. The reason for the exception, which lies in the principle of the natural judge (impartial because it is predetermined by law), is clarified.
