Summary:The The Const. Ap. Praedicate Evangelium introduces two references to the duty of curial institutions to apply law with canonical equity. This article explores the meaning of this provision, re-presenting the classical doctrine of equity, elaborated by legists and canonists and enriched by the reflections of St. Thomas Aquinas. The aequum is apprehended by the attentive gaze of a conscientia a iure informata. Equity prompts the legal practitioner to consider whatever can help him formulate a judgment adequate to the juridical reality.
La Cost. Ap. Praedicate Evangelium introduce due riferimenti al dovere delle istituzioni curiali di applicare il diritto con equità canonica. Il presente articolo approfondisce il significato di questa disposizione, riproponendo la dottrina classica dell’equità, elaborata da legisti e canonisti e arricchita dalle riflessioni di San Tommaso d’Aquino. L’aequum viene colto dallo sguardo attento di una conscientia a iure informata. L’equità spinge l’operatore del diritto a prendere in considerazione quanto lo possa aiutare a formulare un giudizio adeguato alla realtà giuridica.
