After the appeal was admitted, the appellant-respondent abandoned the appeal. The tribunal of first instance inquired of the Roman Rota as to the status of the case, and it was confirmed that the single conforming decree did not suffice as the criteria listed in canon 1679 was not fulfilled; also, res iudicata in case of abandoned appeals (c. 1641, 3) did not occur in light of canon 1643. Therefore, the parties need a second conforming decision and the original petitioner would need to become the pars diligentior in the third instance to seek the affirmative decision.
