| Summary: | Sullo sfondo di un confronto generale tra le attuali categorie del CIC 1983 e quelle del CIC 1917, l'articolo richiama l'attenzione sulle due nozioni di laudatio e commendatio. Le due categorie appaiono in un inciso nel can. 299 § 2 per ricordare che tale applicazione non modifica il carattere privato delle associazioni. La laudatio e la commendatio provenienti dall'autorità ecclesiastica sono i mezzi offerti ai detentori del potere di governo per rendere nota la loro valutazione dell'interesse dei battezzati ad aderire a determinate associazioni create per iniziativa dei fedeli. Il ragionamento conduce l'autore a proporre che, de iure condendo, senza modificare la nuova distinzione delle categorie di associazioni tra pubbliche e private, che, a dire il vero, nonostante la volontà dei membri della Commissione di revisione del primo Codice, non ha fornito la chiarezza desiderata rispetto alle categorie del Codice antecedente, si augura che, in questa parte del Codice dedicato alle associazioni di fedeli, sia aggiunto un canone sulla laudatio e la commendatio. Against the background of a general comparison between the current categories of CIC 1983 and those of CIC 1917, the article draws attention to the two notions of laudatio and commendatio. The two categories appear in an aside in can. 299 § 2 as a reminder that such application does not change the private character of associations. Laudatio and commendatio coming from ecclesiastical authority are the means offered to the holders of governing power to make known their assessment of the interest of the baptized in joining certain associations created by the initiative of the faithful. The reasoning leads the author to propose that, de iure condendo, without changing the new distinction of the categories of associations between public and private, which, truth be told, despite the will of the members of the First Code Revision Commission, did not provide the desired clarity with respect to the categories in the predecessor Code, he hopes that, in this part of the Code devoted to associations of the faithful, a canon on laudatio and commendatio will be added. |
