Summary:The article deals with the relationship between Recht, i. e. actual law as a set of rules for dealing with wrong that has been done, and Ethos, i. e. the moral ideas recommending or commanding how the individual is to act in certain circumstances. The problem is discussed along terminology, type of phrases (justiciable provisions, exhortations, etc.), degree of authority (revealed or based on experience), possible lines of development (from Recht to Ethos or vice versa), and the literary corpora of the Hebrew Bible. The general thesis is that Ethos underlies Recht. Laws are based on moral insights. On the other side, law is indispensable in developped societies to keep them together independant of the subjective moral convictions of their members. The thesis is illustrated in the discussion of the provision of regular release from debts in Deut 15 and the “ethical digest“ (John Barton) of Mic 6:8.
