Summary:The first Vatican Council was preceded by the work of a series of Preparatory Committees. Among these, the Preparatory Commission for Oriental Churches and Missions entrusted to its consultors the drafting of several advisory opinions on topics to be discussed later in the Council. This article presents a detailed summary of Francesco Rosi Bernardini's advisory opinion on whether to declare the Catholic teaching on the indissolubility of marriage a dogma of the faith. This consultor thoroughly examined the issue and concluded that there are sufficient grounds to declare this teaching a dogma, provided that only Oriental Catholics attend the Council. However, he stated, taking into account the circumstances of the time, in the case that the Council is also attended by the Orthodox, seeking unity, it would be convenient not to proclaim the dogma immediately. Rather, there should be a gradual process in this direction, which delays the definition until a more appropriate time. In more recent times, Blessed John Paul II has declared the indissolubility of ratified and consummated marriage as a doctrine to be held definitively, precluding any claim of exception by oikonomia. Thus, the genuine pastoral accompaniment of divorced and remarried persons should always respect this rule of divine law.
