Resumo: | This exploratory examination seeks to understand the relationship between ‘religion’, ‘law’ and ‘morality’ by using a socio-legal approach. The paper will outline theoretical positions concerning the relationship between religion and morality with reference to social theory in order to explore how the relationship has changed over time. This picture will then be tested by reference to law; two legal case studies will be employed: criminal law and charity law. In both areas, there have been significant changes in recent times and this paper will examine how these changes have affected the relationship between ‘religion’, ‘morality’ and ‘law’. The paper will conclude by outlining the benefits of this innovative socio-legal approach, arguing that the study of the relationship between religion, law and society requires a ‘sociology of law and religion’. |
