| Summary: | El artículo recuerda que las circunstancias atenuantes, eximentes y agravantes deben ser tenidas en cuenta por el juez de acuerdo a la norma canónica. Si el legislador las ha puesto es porque obedecen al espíritu del Derecho Penal Canónico y no pueden dejarse de lado en el delito de los clérigos contra el sexto mandamiento cometido con menores. Lo mismo ocurre con el discernimiento acerca de la imputabilidad de un clérigo en estos delitos, que debe hacerse con objetividad y según la ley canónica. Algo que ninguna normativa posterior ha cambiado al respecto. This article remembers that the extenuating and aggravating circumstances must be taken into account by judges regarding the canon law. If the legislator has punt them is because they obey the spirit of Canon Penal Law and then cannot be set apart in the felonies of clergymen against sixth commandment. The same happens with the judgment about the responsibility of a clergyman in these crimes. That must be done with objectivity and according to the canon law. No later legislation has ever changed this. |
