Summary: | We will discuss the History of Spiritism and the History of Law through the receptivity of the Penal Code of 1890, legislated by Baptista Pereira, with emphasis on Article 157, which criminalized spiritism. Through the analysis of historical sources, we investigate the creation of criminal laws and the limited recognition of legal peers. The legislator defended his work in an opinion issued by the Instituto da Ordem dos Advogados Brasileiros and in his Historical Notes published in Revista Jurisprudência. In his arguments, he reinforced the need for spiritism to remain illegal because it is an "indigenous crime", inserted in the Book against Public Tranquility in the chapter referring to public health of criminal laws. |
