L'art. 10 § 2 delle Norme sui delitti riservati alla Congregazione per la dottrina della fede consente che le misure siano imposte fin dall'inizio dell'indagine previa. Nell'applicazione di queste misure l'autorità competente deve considerare diversi elementi per evitare che sia compromessa la buona fama e al contempo sia tutelata la giustizia. L'articolo offre alcune considerazioni pratiche. Canon 1722 provides that precautionary measures can be imposed on the accused in a penal process in order to prevent scandals, to protect the freedom of witnesses, and to guarantee the course of justice. Art. 10 § 2 of the Norms regarding delicts reserved to the Congregation for the Doctrine of the Faith allows the measures to be imposed even from the beginning of the preliminary investigation. In applying these measures, the competent authority must consider various factors both to avoid damaging the good reputation of those involved and at the same time to safeguard justice. The article offers some practical considerations. |
