Summary: | Some perspective’s ideas from ‘the origins of a discipline’ · This paper refers to the research monograph of Alessandro Tira to dwell on the debate about the origins and the role of ecclesiastical law in the Italian legal system. The author recalls the concept of ‘distinction of orders’ to retrace the different fields of jurisdictionalist and separatist thought of the eminent scholars of Italian ecclesiastical law, from Minghetti to Ruffini, from Scaduto to Del Giudice, as well as the concept of ‘detachment from canon law’. The most recent doctrinal and jurisprudential orientations, both national and international, are therefore examined in comparison with new forms of religious experience, thus contributing to the unstoppable evolution of ecclesiastical law. |
