| Summary: | This note aims to account for the Leibnizian conception of the improvability of law. In completing Werner Schneiders’ great analysis of the normative function of the city of God published in 1977 in Studia Leibnitiana, we show that this improvability is nothing but an agreement between positive and natural laws. We also show how this agreement may be realized. Since Leibniz deals with the continuity between natural and moral worlds only from a metaphysical point of view, we give for the first time a new justification of this continuity from a legal and political point of view. RésuméCette note vise à rendre compte de la conception leibnizienne de la perfectibilité du droit. En complétant l’analyse de la fonction normative de la cité de Dieu opérée par Werner Schneiders dans un article canonique publié en 1977 dans les Studia Leibnitiana, nous tenterons de montrer comment cette perfectibilité du droit se ramène à la recherche d’une conformité du droit volontaire au droit naturel et à quelles conditions elle est réalisée. Nous donnerons ainsi une nouvelle justification, d’un point de vue juridico-politique, de la continuité entre le monde naturel et le monde moral que Leibniz n’aborde explicitement que d’un point de vue métaphysique. |
