| Summary: | Après avoir rendu compte de la manière dont la Commission pontificale pour la révision du droit canonique a examiné les réponses aux questions posées en 1971 aux évêques du monde entier à propos du projet de Loi Fondamentale de l'Église, l'article établit une comparaison précise entre le projet de 1971 et un nouveau projet de 1976. Il procède ensuite à une étude critique très détaillée des diverses parties du texte du projet: canons 1-8 (l'Église et sa vocation) ; can. 9-28 (droits et statut des fidèles) ; can. 29-39 (pape et collège episcopal) : can. 40-54 (patriarches, évêques , prêtres, diacres) ; can. 66-82 (les fonctions ecclésiales) ; can. 83-86 (normes finales). Cet examen minutieux permet à l'A. de dégager la véritable intention de ce projet de Loi Fondamentale, et de proposer enfin quelques brèves conclusions qui sont autant de questions. After having taken account of the way in which the Pontifical Commission for the Revision of Canon Law has examined the answers to the questions put to the bishops of the entire world in 1971 regarding the project of the Fundamental Law of the Church, the article sets a precise comparison between the project of 1971 and a new project of 1976. It proceeds then to a very detailed critique of the different parts of the project's text: canons 1-3 (The Church and its vocation) ; can. 9-28 (Law and regulation of the faithful) ; can. 29-39 (Pope and Episcopal College); can. 40-54 (Patriarchs, bishops, priests, deacons); can. 55-82 (the ecclesial functions) ; can. 83-86 (Final Norms). This minute examination allows the article to ascertain the real intention of this project of Fundamental Law, and finally, to propose some brief conclusions which are, just as much, questions. |
