Plus qu'une théorie du contrat, on a, chez Hooker, une théorie du consentement. L'auteur examine les rapports de ce concept avec d'autres notions: coutume, acte volontaire, « fellowship ». Il apparati, en conclusion, que le consentement prend une triple valeur : objective (il a pour objet le bien commun), subjective (il est l'acte d'un agent libre), intersubjective (il est harmonie des esprits et des cœurs). One can find two opposite conceptions in Hooker: according to the one society is a fact of nature, for the other it is the result of a contract. This opposition vanishes when one situates Hooker's thought in the context of medieval political Aristotelianism : convention articulates with nature. More than a contract theory, one finds a theory of consent in Hooker. The author examines the relations of this concept with other concepts, such as custom, the voluntary act, fellowship. It appears then that consent assumes a threefold value: an objective value (its object is the common good), a subjective value (it is the act of a free agent), an intersubjective value (consent is harmony between spirits and souls). | ||
