Il primo attiene alla natura pubblica della causa penale, che è messa in evidenza dal diverso ruolo rivestito dal promotore di giustizia, attore del giudizio, e dalle persone che si ritengono lese dal delitto, alle quali è consentito di intervenire nel processo penale per rivendicare più efficacemente i propri diritti lesi. Il secondo attiene alla presunzione di innocenza contenuta già nella stessa definizione della certezza morale necessaria per la pronuncia penale. Il terzo riguarda la funzione distinta (anche se non separata) che riveste la richiesta di riparazione del danno (richiesta costitutivamente di diritto privato) rispetto alle finalità della pena (tutte di diritto pubblico). | ||

The first concerns the public nature of the criminal case, which îs highlighted by the different roles played by the promoter of justice, the actor of the trial, and by the people who consider themselves injured by the crime, who are allowed to intervene în the criminal process to claim their injured rights more effectively. The second relates to the presumption of innocence contained in the very definition of moral certainty necessary for the penal pronouncement. The third concerns the distinct (although not separate) function of the claim for damages (constitutively required by private law) with respect to the purposes of the penalty (which - all fall under public law). | ||
