| Sumario: | The present study puts of relief that the protection to the family who proclaims the Universal Declaration of Human rights recognized in article 16.3 like «the natural and fundamental element of the society», supposes that the States,and the different societies, have to establish mechanisms by which it equips tothis institution with a special protection and shelter to all his members. Some European countries have including in their constitutional texts rules dedicated to guarantee the social rights, demanding therefore a greater responsibility to the powers public in their political action. Within this group of rights references to the family are made in some constitutional texts. These cases are analyzed seeingas it is the constitutional reach that is granted to the protection of the familiar institution. El presente estudio pone de relieve que la protección a la familia que proclama la Declaración Universal de Derechos Humanos reconocida en el art. 16.3 como «el elemento natural y fundamental de la sociedad», supone que los estados,y las distintas sociedades, establezcan mecanismos por los que se dote aesta institución de una especial protección y amparo a todos sus miembros. Algunos países europeos han incluido en sus textos constitucionales preceptos dedicados a garantizar los derechos sociales, exigiendo así una mayor responsabilidad a los poderes públicos en su acción política. Dentro de este grupo de derechos se realizan referencias a la familia en algunos textos constitucionales. Se analizan estos casos viendo cual es el alcance constitucional que se otorga ala protección de la institución familiar. |
