Summary:Constitutional regimes in Spain at the time of the Second Republic and the era of General Franco are studied in this article. They are necessary background for a correct comprehension of article 16.3 of the current Spanish Constitution, in so far as the 1978 constitution avoids the return to previous ones. After an analysis of several current confessional and non confessional systems, the Spanish system is described as non confessional and cooperative with the Church and other confessions.
Como elemento necesario para comprender el sentido y significado del vigente artículo 16.3 de la Constitución española, se evocan, en sus principales notas distintivas, los dos regímenes constitucionales que inmediatamente le preceden IIª República y Régimen del General Franco), a ninguno de los cuales el constituyente de 1978 quiso volver. Se analizan los sistemas vigentes de confesionalidad y aconfesionalidad religiosa del Estado y se califica el sistema español como de aconfesionalidad y cooperación con las Iglesias y confesiones.
