Si sofferma poi sul primo requisito di ammissibilità al processo più breve (il consenso dei coniugi), esaminando le diverse ipotesi di interpretazione del dettato normativo, e affronta infine la domanda circa l'impugnabilità della scelta della via processuale. The article offers a panoramic view of the entire introductory phase of the cases of matrimonial nullity as reformed by the motu proprio of Pope Francis, Mitis Iudex Dominus Iesus, in order to highlight some issues connected to the choosing of the type of process. It then treats of the first requirement for admissibility to the briefer process (the consent of the spouses), examining the different possible interpretations of the relevant legal text, and finally addresses the question of whether the choice of the trial type can be challenged. |
