Summary: | Nel testo costituzionale italiano la funzione educativa genitoriale a sfondo religioso è delineata in forma ambivalente, nei termini di un diritto-dovere in capo a entrambi i genitori. Ciò nonostante, analizzando la giurisprudenza che si è pronunciata sul tema sin dalla seconda metà del 1900 si registra una scarsa attenzione alla tutela del diritto dei genitori di educare la prole al proprio credo, in particolar modo nella fase patologica della coppia, ossia nei procedimenti di separazione, divorzio e di affidamento dei figli nati fuori dal matrimonio. Il saggio, attraverso un’analisi delle più rilevanti pronunce in tema di educazione religiosa della prole, giunge a delineare il concreto ambito di operatività del diritto genitoriale, mettendo in luce la recente tendenza della giurisprudenza ad accordargli maggiore risalto, sebbene contemperato dal ruolo attivo ormai pacificamente riconosciuto al minore nelle scelte che lo riguardano. In the Italian Constitution, the parents’ educational role with a religious background is delineated in an ambivalent way, in terms of a right-duty of both parents. However, analysing the jurisprudence that has been pronounced on the matter since the second half of 1900’s, scarce attention has been paid on how to protect the parents’ right to educate their children according to their own beliefs, in particular in case of abnormal situation during the relationship, i.e. separation, divorce and custody proceedings for children born out of marriage. The essay, through an analysis of the most relevant pronouncements on the topic, comes to outline the concrete area of operation of parental rights, highlighting the recent trend of jurisprudence that gives great prominence to the considered topic, although balanced by the now recognized active role of the child in choices about himself. |
