Description
Summary:The author, based on the abstract qualification of presumptions as proofs (cann. 1584-1586) and their systematic placement among proofs in the current Code, proposes an application of them in the individual phases of the ordinary contentious process and, therefore, of the process of matrimonial nullity (cf. can. 1691 §3). From this, their nature as proofs is confirmed a posteriori, with interesting consequences especially in relation to the exercise of the right of defense.
L’Autore, sulla base della qualificazione astratta delle presunzioni come prove (cann. 1584-1586) e della loro collocazione sistematica tra le prove operata dal Codice vigente, propone una applicazione di esse nelle singole fasi che la dinamica del processo contenzioso ordinario e quindi del processo di nullità matrimoniale (cf. can. 1691 §3). Ne risulta in tal modo confermata come a posteriori la loro natura di prove con interessanti conseguenze soprattutto in relazione all’esercizio del diritto di difesa.
