| Summary: | This paper aims to highlight the variable character of the category of corruption in current public law theories. This term is mainly used for moral considerations, but without paying any attention to the fact that the moral disapproval of conduct defined as corrupted is already implied in the definition itself. The Author affirms that greater clarity is necessary when formulating the arguments that justify this moral judgement. A similar discourse applies to the question of what practices can be defined as corruption and then publicly prosecuted and punished under criminal law. By strictly applying the principle nulla pœna sine lege, such requirement becomes inescapable if one wants criminal law to be effective in society. Finally, the category of corruption is part of the theological analysis, characterizing human existence from the viewpoint of its submission to sin. Questo testo intende mettere in evidenza il carattere fluido della categoria di corruzione, così come viene sovente usata nella pubblicistica contemporanea. Il termine viene soprattutto impiegato per considerazioni moralistiche senza rendersi conto del fatto che la disapprovazione morale di condotte così connotate sia già contenuta nel termine stesso. L’Autore postula la necessità di formulare con maggiore chiarezza gli argomenti che giustificano tale giudizio morale. Le pratiche di corruzione inoltre vanno ancora maggiormente precisate quando si tratta di sanzionarle pubblicamente mediante norme penali. Applicando rigorosamente il principio nulla pœna sine lege questa esigenza diventa necessaria se si vuole rendere operativo un diritto penale che incida sulla realtà sociale. In fine la categoria di corruzione è presente anche nella riflessione teologica, connotando l’esistenza umana sotto la dominazione del peccato. |
