| 520 | |a La Segnatura Apostolica fa pubblicare una propria decisione “coram Vallini” dell’anno 2007 nella quale ribadisce l’incompetenza assoluta della Rota Romana a “vedere” della nullità delle proprie Sentenze, senza che rilevi in alcun modo il nomen Iuris che tale intervento assuma: “Retractatio” (anche d’Ufficio, se necessario) come la chiama la Sentenza in commento (secondo la denominazione codiciale), oppure “Querela nullitatis”, secondo la rubrica della decisione “coram Vallini”. L’interesse del supremo Tribunale è rivolto alla sostanza della questione, costituita dalla nullità della Sentenza rotale, senza dare adito ad interpretazioni formalistiche di ciascuno dei riferiti istituti, come se si potessero ritenere incompatibili Querela e Retractatio. Significativo della decisione è anche il suo essere intervenuta prima della Notifica della Sentenza della Causa di cui si trattava. | ||

The interest of this Supreme Court is addressed to the substance of the ques-tion, constituted by the nullity of the Rota Decision, without giving rise to formalistic interpretations of each of the referred institutions, as if Querela and Retractatio could be considered incompatible. The significance of this decision is also its having been published prior to the Notification of the decision of the case in question. | ||
