| Summary: | La formula nullitas Matrimonii ob defectum Consensus tocca il centro dell’indagine giudiziale del Processo di nullità matrimoniale, ove permane la necessità di considera-zione della persona in senso olistico. Il recupero di questa formula nelle Sentenze del Tribunale della Rota Romana permetterebbe di qualificare in modo corretto la nozione di Capo di nullità specialmente in relazione al fatto storico. L’impatto di questo aspetto sui Tribunali inferiori riguarda la possibilità di una modalità nuova di formulazione del dubbio di Causa, soprattutto in presenza di più Capi di nullità tra loro c.d. incompatibili. Infatti, riconducendo l’asse centrale dell’indagine sul Consenso, causa delle nozze, che è atto della persona considerata nella sua complessità ed integrità, di fronte a fattispecie fattuali che apparentemente sarebbero da ricondurre a zone grigie, si sostiene il valore della formulazione del dubbio in forma non subordinata ma coordinata, forma applicata anche dalla Giurisprudenza rotale più accreditata, poiché in grado di non tradire la corretta definizione giuridica della verità dei fatti addotti dalle parti. The formula nullitas Matrimonii ob defectum Consensus affects the core of the judi-cial investigation of the Marriage Nullity Process, where there remains the need for a holistic consideration of the person. The revival of this formula in the Decisions of the Roman Rota Tribunal would enable the notion of the Ground of nullity to be correctly described especially in relation to the historical fact. The impact of this aspect on the lower Tribunals concerns the possibility of a new way of formulating the doubt of the Case, especially in the presence of several but incompatible Grounds for nullity. In fact, focusing the investigation on Consent –which is the reason for the wedding and act of the person considered in their complexity and integrity– when the facts of the Case would apparently be linked to gray areas, we value the formulation of the doubt in an unconditional but coordinated form; a form also applied by the most important Rotal Jurisprudence, since it is capable of not betraying the correct legal definition of the truth of the facts alleged by the parties. |
