| Summary: | Le Norme che regolano il vigente Processo matrimoniale canonico sono frutto di alcune modifiche apportate al CIC dal m.p. “Mitis Iudex” in connessione alla riflessione sulla famiglia che si è svolta nel Sinodo dei Vescovi del 2014. Le novità normative introdotte sono espressione di una rinnovata sensibilità pastorale che si realizza concretamente attraverso la specifica formalizzazione della “fase previa”, ormai disciplinata da Norme puntuali, e attraverso la valorizzazione della dimensione interpersonale che appartiene al Processo canonico in tutte le sue fasi.In questa dinamica s’inserisce anche il contenuto della Sentenza che oggi in maniera più evidente esprime il suo valore funzionale alla cura e all’evangelizzazione della persona. L’attenzione al Processo matrimoniale ha consentito anche una riflessione più profonda sulle modalità d’esercizio della potestà giudiziale, sulla responsabilità e funzione dei Tribunali ecclesiastici nella missione della Chiesa. The Norms governing the current canonical matrimonial Process are the result of some changes made to the CJC by the M.P. “Mitis Iudex” following the reflection on the family that took place in the 2014 Synod of Bishops. The new Norms introduced are the expression of a renewed pastoral sensitivity which is concretely achieved through the specific formalization of the “preliminary phase”, now regulated by precise Norms, and through the enhancement of the interpersonal dimension that belongs to the canonical Process at each and every stage.This dynamic also includes the content of the Decision which today more clearly expresses its value for the care and evangelization of the person. Attention to the matrimonial Process has also allowed a deeper reflection on the methods for exercising judicial power, and on the responsibility and function of ecclesiastical Tribunals in the mission of the Church. |
