Summary: | In Judaism, marriage is perceived as a unity and harmony in creation intended by the Creator, a duty, since it guarantees the duration and development of human kind, and an institution, based on a civic contract. There is an ongoing debate as to whether the institution of marriage is a bibical prescription or whether it is described in the Bible but not binding on a biblical level. Nevertheless, the rabbis created a ceremony whereby a man and a woman must enter into this relationship. The present article describes the aforementioned dimensions of marriage in Judaism, providing refrences to textual (i.a. the Hebrew Bible, the Talmud, the Shulchan Aruch) and ceremonial bases for the holy state (i.a. kiduszin, ancient rabbinic texts) which marriage is deemed to be. The author places a special emphasis on the notion of marriage by proxy which - in the Jewish tradition - dates back to Talmudic times |
