| Summary: | Este artículo recoge un estudio jurisprudencial del c.1097 referido al error en la persona y en cualidades que redundan en la persona. El estudio está dividido en dos partes. La primera está dedicada al estudio del error en la persona y la segunda al error en cualidad que redunda en la persona. La Jurisprudencia entiende el concepto de persona como individuo físico distinto de los otros. Pero a su vez sigue valorando el error que redunda en error de la persona y de las cualidades individuantes como una clase de error en la persona, concediéndoles el mismo efecto invalidante que al error substancial sobre la persona. This article gathers a jurisprudential study of c. 1097 referred to the error about a person and about the qualities that redound to the person. The study is divided in two parts: the first one is dedicated to the study of the error about a person and the second one to the error about a quality that redounds in the person. The Jurisprudence understands the person's concept as physical individual person different from others. But at the same time he continues valuing the error of person, granting the same invalidating effect to them that to the substantial error of person. The second part, wider than the previous one, studies what qualities can be an object of the assent. Also there is studied that understands the Jurisprudence for "direct and principal intended" at the moment of evaluating the directly asked qualities. There are exposed also the criteria applicable to the "implicit intention" according to the Jurisprudence. This study finishes with a summary that brings over of the proof of the error about an individual quality |
