| Summary: | El el presente trabajo se realiza, en primer lugar, un estudio comprobado del derecho procesal civil italiano y español sobre el doble grado de jurisdicción, usando un método histórico-sistemático. Así, y en relación con los fundamentos del doble grado subrayamos las siguientes constataciones que se derivan de los razonamientos favorables y contrarios al mismo: la preocupación por revalorizar el papel del tribunal de pimer grado, así como el no entender de un modo autoritario la jerarquía entre tribunales; deseo auténtico de que los ciudadanos obtengan de los tribunales, sin dilaciones indebidas, la justicia anhelada; se quiere dar la oportunidad para poder reclamar contra una decisión considerada injusta pues todo ciudadano tiene constitucionalmente reconocido el derecho a la defensa. Esto es, en los ordenamientos procesales estatales, aun acogiendo el favor veritatis, se da mayor espacio y fuerza al rincipio de la certeza del derecho- En segundo lugar, ofrecemos un estudio sobre el origen y la naturaleza del principio procesal canónico de la doble sentencia conforme, prgundándonos si como tal responde al deseo de obtener un pronunciamiento congruente con el favor veritatis. A continuación se ilustran los vínculos que la doble sentencia conforme puede tener con el favor matromonii y con la exigencia de certeza moral. La subjectividad de los jueces de sugundo grado puede tener una incidencia importante en orden a obtener la verdad sustancial, lo cual nos lleva a analizar el mismo concepto de conformidad de sentencias, llegando a través de éste análisis, a la asunción de la conformidad sustancial o equivalente. The double grade of jurisdiction and the conforming double sentence The article offers firstly a comparison, using a historical-citical method, of the double grade of jurisdiction in Italian and Spaniah civil law. In relation to foundations of the double grade, we underline the following considerations which flow from the arguments for and against the same: the attempt to revalue the role of the court of first instance, without interpreting in an authoritarian way the hierrarchy of the courts; the real desire that citizens should be able to obtain the justice they seek from the courts without undue delay; the wish to afford everyone the possibility of appeal against a decision which they consider unjust, given that every citizen has a right to self-defence found in the constitution. In the legal systems of the state, even though they accept the favor veritatis, greater space and importance is attributed to the principle of the certainty of law. Secondly, the article offers a study on the origin and nature of the procedural principle in canon law of the double conforming sentence, wondering if it really answers the desire to produce a judgement consistent with the favor veritatis. The article goes on to illustrate the links that the double conforming sentence may have with the favor matrimonii and with the need for moral certainty. The subjectivity of the second instance judges may play great importance in determining the substancial truth, which leads us to analyse the very concept of conformity of sentences, thus arriving from this analysis at the assumption of substancial or equivalent corformity |
