Description
Summary:The article - which should be read in parallel with the clinical contribution an the topic - presents the canonical aspects involved in the topic, especially by studying the relapse of the consequences of suffered abuse not only on the psychic and physical capacity of the person enduring such consequences, but also in the perspective of other grounds of marriage nullity or of the hypothesis of marriage breakdown. It then presents eight practical cases, which illustrate concretely the relapses of canonical relevance in such perspective. Having dealt with the theme of proof, not only in relation to the expert and to the contribution that has to be sought from him, but also in relation to the so called documental or oral proofs, which present a delicate nature that is all particular in cases where eventual abuses concern the sexual sphere. After having presented some judgements of the Roman Rota that are particularly instructive on the theme follows the treatment of the theme concerning the behaviour to be had in relation to eventual news of crime which could emerge in the context of an instruction of a matrimonial canonical case.
