Summary:March 13, 2013, wight days before Pope Francis' Election, the Dean of the Roman Rota made public that Pope Benedict XVI had sent him a Rescriptum with five "special powers". These "concessions" in marriage processes rather than granting "a privilege, dispensation, or other favor at someone's request" (c. 59.1 CIC 83), suppress fundamental rights if the faithful. The procedure does not seem suitable. Present essay analyses each special faculty from both the formal and the substantive point of view. "Salus animarum" and the superiority of the "veritas materialis" are the main principles that inspire the conclusive considerations
