Summary:Canon Law as Instrument of Dialogue and Evangelization - The author starts out with a survey of the anthropological as well as philosophical foundations of canon law, with a special focus on human person's fundamental rights. Then he deals with the theological foundations of canon law and highlights the contribution given by juridical-canonical speculation to modern culture as well as the risk undergone by the Church to uncritically assimilate some modern juridical and philosophical principles (Particulary with reference to the idea of code and custom as well as of the principle of legality). Eventually the author underlines canon law dynamic role and his evangelizing potential (particularly with reference to the classification of the person's fundamental rights, the strong link between education and government, the illuminist theory of the separation of powers and, in the context of criminal law, the personalistic idea of culpability)
